I, Andrew DeFaria, a United States Citizen, filed an I-129F on behalf of my fiancée, Olga Fedoryaka, in October 2000 and which was subsequently approved by the California Service Center on January 2, 200

Following an interview by the consulate in Warsaw, Poland on April 23, 2001 with the petitioner and beneficiary, the file was sent to the Western Service Center for Administrative Review pursuant to 9 FAM, Part 41. The case was shipped via registered mail (No. 4382893) to Laguna Niguel on May 16, 2001 and has been said to have left to Dulles Air force Base on May 22, 2001.

I, the petitioner, have been in contact with a Mrs. Laura Cavalier of INS in Laguna Niguel regarding this situation. On March 4, 2002 I spoke with Mrs. Cavalier and she relayed to me that she had gathered all of the information and reviewed my file. She told me that the INS would be sending me a notice of pending revocation which would give me the opportunity to address the concerns raised by the consular officer in Warsaw. The main concern appears to be that the consular officer was suspicious about my fiancée's prior second marriage to a US Citizen in 1996 being short. Even through Mrs. Cavalier had told me that if the INS does not find any application for a visa benefit for this second marriage, and there was none because they never filed anything, that the INS would reaffirm the petition and send it back to Warsaw Mrs. Cavalier said that the INS would be sending me a notice of pending revocation anyway. Mrs. Cavalier assured me that she would speak with the district director the next day and that the notice would go out shortly after that. I still have not received that notice. Until I receive that notice I am impeded from taking action.

I have called Mrs. Cavalier numerous times enquiring about the status of the notice of pending revocation - has it been processed? - has it been sent? - however I have only been able to reach her voice mail. I have left several messages but she has never returned my calls.

Please let me know if the notice of pending revocation has been process and whether or not it's been sent along with the date it was processed and/or sent. This case has been delayed long enough and it should be my turn to address the issues.
