Administrative Review of Approved I-129F

Dear Ms. Cavalier:

I thank you for taking personal attention to my case and I do not wish to abuse that privilege. However, this weekend I received a letter from Senator Boxer's office that contained a bit of very distressing news in direct contradiction to what you had told me on the phone. As such I felt compelled to contact you to verify this. Which is correct? You or them?

The following is verbatim of an email from somebody in the INS identifying herself simply as Yolanda sent to Senator Boxer's office:

Masha,

I have been informed that a physical review of the file show that the I-129F petition was received from the consulate and has been consolidated into the A-file and is housed at this office. Consulate returns are a low priority and will be processed in the order it was received. At this time it is taking longer than 3 years until assigned for review and final disposition is rendered.

I hope you can understand my concern here. First you tell me that they are starting to process returned petitions from 1999 and to check back with you in 60 days and add "But it will not take 2 years because there are not that many returned petitions a year" and then I get a letter from my senator with a response from the CSC saying it will take "longer than 3 years". Which of you is correct?!?

Also, I assume that all of these estimates are relative to some start date. What start date is it relative to? Logic would suggest from the date that the CSC receives the petition back. Only recently have I learned that my petition is indeed back at the CSC, yet I have never been told when it arrived there. Do you know the date the CSC received my petition back?

If you could I would really appreciate a little note to clear up this matter. You could call me or email me or send me a quick little letter. Thanks.

Very truly yours,

Andrew DeFaria
