35 to file a formal complaint against a consular officer in the Warsaw Embassy
\r
36 in Poland. Unfortunately I do not have the name of this officer despite repeated
\r
37 attempts to contact the embassy and obtain his name. I've been trying to get
\r
38 his name for approximately 4 months now and they simply refuse to give me
\r
39 that information. What I can say is that he was a relatively tall with short
\r
40 blonde hair and appeared to be one of the two American officers working at
\r
41 the windows there. He described his self as the supervisor. The other American
\r
42 consular there was in training at the time.</font></small><small><font face="Helvetica, Arial, sans-serif"><br>
\r
43 </font></small><small><font face="Helvetica, Arial, sans-serif"><br>
\r
44 </font></small><small><font face="Helvetica, Arial, sans-serif">Here is
\r
45 my the story that explains why I fell compelled to report this consular as
\r
46 abusive and as having shown a prejudice against me and my fiancée.
\r
47 This prejudice is causing me extreme emotional pain as I have been forced
\r
48 into a very lengthy and frustrating battle with the Immigration and Naturalization
\r
49 Service and may even be faced with never being able to bring my fiancée
\r
50 here to America to live with me. I realize that filing this complaint will
\r
51 not help my case with the INS however I feel that as an American I must register
\r
52 my grievances so that future Americans will hopefully not need to experience
\r
53 this abuse and prejudice.</font></small><small><font face="Helvetica, Arial, sans-serif"><br>
\r

\r
56 Olga Fedoryaka, and I were scheduled for an interview at the Warsaw Embassy
\r
57 on April 23, 2001 so that she could obtain a Fiancée Visa. Shortly
\r
58 after my fiancée's interview started this blonde haired consular pulled
\r
59 me aside to another window and asked me why I wanted my fiancée. I
\r
60 was not aware that it is customary to interview the petitioner at such visa
\r
61 interviews! I told him that I loved her and wanted to bring her to America
\r
62 to be my wife. He then asked if I was aware that my fiancée was in
\r
63 the U.S. before. I responded that she had not been deported. He looked at
\r
64 me very sternly and menacingly, raised his voice and scolded me "Now don't
\r
65 be trying to get legal with me!". I told him I was not trying to get legal
\r
66 with him I was just trying to inform him that she was not deported and apologized.
\r
67 Needless to say at this point I was very nervous and intimidated. I did not
\r
68 feel that I needed to be scolded by him nor intimidated by him however I was
\r
69 worried if I didn't go along with whatever he said that he would deny my
\r
70 petition. In other words I felt very threatened by him. </font></small><small>
\r
72 <p><small><font face="Helvetica, Arial, sans-serif">Next he asked me if I
\r
73 knew that she had been married twice before and that he believed that she
\r
74 was just using me to get a ticket to America. I told him that I was fully
\r
75 aware of her prior marriages and had discussed it with her on many occasions.
\r
76 I told him that I had even spoken with her first ex husband on the phone.
\r
77 He seemed satisfied with that and let me return to my fiancée and the
\r
78 interview. </font></small></p>
\r
80 <p><small><font face="Helvetica, Arial, sans-serif">Later on in the interview
\r
81 my fiancée and the other consular interviewer were discussing her exit
\r
82 from the U.S. in 1997. The blonde supervisor stopped by and joined in the
\r
83 discussion. With four of us there together there started to be a little confusion.
\r
84 The blonde supervisor was now pressing on my fiancée again in an authoritative
\r
85 and threatening manner. He was all confused about the sequence of events.
\r
86 I attempted to interrupt and explain to him what he was misinterpreting.
\r
87 He turned to me and like a dog owner barked at me in a harsh tone and instructed
\r
88 me to go sit down. After a few minutes he motioned for me to return only
\r
89 to explain to me that he was overruling the interviewer and sending this
\r
90 petition back for administrative review. </font></small></p>
\r
92 <p><small><font face="Helvetica, Arial, sans-serif">Now I understand and appreciate
\r
93 that it is the consular's job to weed out undesirable applicants. However
\r
94 I do not feel, as an American citizen, that I need to be threatened, intimidated
\r
95 and told that my choice of a spouse is wrong by members of my own government!
\r
96 Further it seems to me that this blonde haired supervisor had clearly expressed
\r
97 his bias towards my fiancée in the first 5 minutes of the interview
\r
98 way before making any objective decisions. And I do not appreciate having
\r
99 to suffer for somebody else's prejudices!</font></small></p>

101 <p><small><font face="Helvetica, Arial, sans-serif">In my latest attempt to
\r
102 ascertain this consular's name another employee of the Embassy emailed me.
\r
103 Normally they do not identify themselves however this time they did. It
\r
104 was signed Maria Rudensky Silver, Chief Immigrant Visa Section. I had emailed
\r
105 Ms. Silver back inquiring again for that blonde haired consulars name. As
\r
106 expected she has not responded. I therefore feel compelled to also file a
\r
107 formal complaint against Ms Silver for refusing to provide me this man's
\r
108 name.</font></small><small><font face="Helvetica, Arial, sans-serif"><br>
