  36 <p> Which <b>exact</b> facts of the beneficiary's prior marital history were \r
  37 not consistent with the information in the approved petition? We had made \r
  38 no attempt to hide the fact that my fiancee was married twice before while \r
  39 in the US, in fact we provided divorce decrees for both marriages! So I fail\r
  40 to see what facts about my fiancees prior marital history were inconsistent \r
  41 with the information in the approved petition. Could you clarify this?</p>\r
  42 <p> And according to 9 FAM 42.43 N2.1 Petitions Approved in Error: </p>\r
  43 <blockquote>The approval of a petition is usually considered to be prima facie\r
  44 evidence that the alien beneficiary has met the petition requirements. Unless\r
  45 a petition has been approved in error, the petition can only be returned\r
  46 if the consular officer knows, or has reason to believe, that the beneficiary\r
  47 is not entitled to status. Knowledge and reason to believe must be based\r
  48 upon evidence that the INS did not have available at the time of adjudication.\r
  49 This evidence often arises as a result of or during the consular officer&#8217;s\r
  50 interview. <u>Reason to believe must be more than mere conjecture or speculation</u>\r
  51 &#8212;there must exist probability, <u>supported by evidence</u> that the alien\r
  52 is not entitled to status.</blockquote>\r
  53  And 9 FAM 42.43 N2.2 Cases of Sham Marriages: \r
  54   <blockquote>INS has minimum evidentiary standards that must be established \r
  55 before revocation proceedings may begin. These minimum evidentiary standards \r
  56 are: \r
  57     <p>(1) A written statement from one or both of the parties to the marriage \r
  58 or documentary evidence that money exchanged hands; or </p>\r
  59     <p>(2) <u>Factual evidence developed by the consular officer that would \r
  60 convince a reasonable person that the marriage was a sham marriage entered \r
  61 into to evade immigration laws.</u></p>\r
  62     </blockquote>\r
  63  Where is this factual evidence? Please be detailed. I need to see this factual\r
  64 evidence in order for me and my lawyer to adequately prepare our case. \r
  65     <p>Specifically, as stated in 9 FAM 42.43 N2 Returning Petition: "In\r
  66 most instances when action is suspended the consular officer shall: (1) Prepare \r
  67 a covering memorandum which constitutes a&nbsp; comprehensive report to INS\r
  68 explaining in detail the reasons why the beneficiary appears not to be entitled\r
  69 to status", I would like that report (and neither the embassy in Warsaw nor\r
  70 the INS here in California has provided me with that information - and remember\r
  71 the INS in California does not respond to my requests (see below)). </p>\r
  72  It is a practical impossibility to contact the INS office in Laguna Niguel. \r
  73 I have been trying for weeks. Their number is <b>always</b> busy. I have faxed\r
  74 them and they do not respond. It is also an impossibility to provide them\r
  75 with additional information when both your office and the INS here in Laguna\r
  76 Niguel refuse to clearly state exactly what the problem is! Vague terms of\r
  77 "several pieces of information" provide me no information of what additional\r
  78 information I might be able to submit to support my case because the case\r
  79 and/or the problem has never been clearly articulated!\r
